1. Acceptance of Terms

By downloading, installing, opening, or otherwise using the EM Channel mobile application, or by browsing this marketing website, you confirm that you have read, understood, and agreed to be bound by these Terms and by any policies referenced in them, including our Privacy Policy. If you are using the service on behalf of another person, you represent that you have authority to bind them to these Terms. If you do not accept these Terms, please uninstall the app and discontinue use of the website.

2. The Service

EM Channel is a free Android application for reading manhwa, comics, and similar illustrated serial works. The app aggregates chapters from publicly available and user-submitted sources and provides a reader interface, library management, and notifications when new chapters are released. Chapter and announcement updates are also distributed through our Telegram channel at t.me/emscanschannel.

The EM Channel APK is distributed exclusively through our Telegram channel and this website. The app is not available on the Google Play Store. If you obtain the APK from any other source, we cannot guarantee its authenticity, safety, or that it matches the official build. This website (emchannelapp.org) serves as the official marketing page for the app and points users to the legitimate download source.

3. Eligibility

You must be at least 13 years old to use the service, or the minimum digital consent age in your jurisdiction, whichever is higher. If you are under 18 (or the legal age of majority where you live), you may only use EM Channel if your parent or legal guardian has reviewed these Terms with you and consents on your behalf. By using the service, you represent and warrant that you meet these eligibility requirements.

4. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the EM Channel Android application on devices you own or control, for your personal, non-commercial use only.

You may not (and may not allow any third party to): reverse-engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent such restriction is prohibited by applicable law; modify, adapt, or create derivative works of the app; redistribute, sell, rent, lease, or sublicense the APK or any modified version of it; remove, alter, or obscure any copyright, trademark, or other proprietary notices; or use the app for any commercial purpose without our prior written permission.

5. Acceptable Use

You agree not to:

• Use the service in any way that violates applicable laws or regulations.
• Use automated systems, bots, scrapers, or crawlers to access, copy, or extract content from the app or our backend services.
• Republish, mirror, or redistribute content obtained through the app on other platforms.
• Probe, scan, or test the vulnerability of any system or network connected to the service, or breach any security or authentication measures.
• Reverse-engineer the app's API, intercept network traffic to discover private endpoints, or attempt to construct competing services from data obtained through the app.
• Take any action that imposes an unreasonable load on our infrastructure or that would degrade the experience for other users.
• Impersonate any person or misrepresent your affiliation with anyone.
• Use the service to transmit malware, spam, or any harmful or unlawful content.

6. Content Disclaimer and Takedown

EM Channel is a reader and aggregator. We do not author, own, or claim any rights to the underlying manhwa, manga, comics, or other illustrated works displayed in the app. The catalog draws from user-submitted links and publicly available sources on the open internet; the copyrights and trademarks in the works themselves belong to their respective creators, publishers, and licensors.

If you are a rights-holder (or an authorized representative of one) and you believe that content available through the app infringes your rights, please contact us with the following information so we can act quickly:

• Identification of the work or works claimed to be infringed.
• Identification of the material in the app you believe is infringing, with enough detail (series name, chapter, screenshot) to locate it.
• Your contact information (name, organization, email).
• A statement, made in good faith, that you are the rights-holder or authorized to act on the rights-holder's behalf, and that the use is not authorized.
• A signature (electronic is fine).

7. No Warranty — "As-Is"

The service is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, and uninterrupted or error-free operation. We do not warrant that the app will meet your requirements, that any defects will be corrected, that the service will be available at any particular time or location, or that content viewed through the app is accurate, up to date, or free of errors. Your use of the service is at your sole risk.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall EM Channel, its operators, contributors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, system failure, or the cost of substitute services, arising out of or in connection with your use of (or inability to use) the service, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our aggregate liability to you for all claims arising out of or relating to the service is limited to the amount you have paid us, if any, in the twelve (12) months preceding the event giving rise to the claim. Because the EM Channel app is provided free of charge, this amount is, in practice, zero.

9. Advertising

The app may display advertisements provided by third-party ad networks. These advertisements help us keep EM Channel free for users. We do not endorse, sponsor, verify, or take responsibility for the content of any third-party advertisement, for the products or services advertised, or for any external website that an advertisement links to. Your interactions with advertisers and any decision to click, install, purchase, or otherwise engage with their offerings are solely between you and the advertiser. Third-party ad networks may collect or process limited information about your device; please refer to our Privacy Policy for details on what data is shared and how to manage your preferences.

10. Termination

We may, at our sole discretion and without prior notice, suspend, restrict, or terminate your access to all or part of the service if we reasonably believe you have violated these Terms, applicable law, or the rights of others, or if doing so is necessary to protect the security or integrity of the service. You may stop using the service at any time by uninstalling the app from your device and ceasing to visit the website. Provisions of these Terms which by their nature should survive termination (including the disclaimers, liability limits, and content ownership provisions) will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in the app, the law, or our practices. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will additionally post an announcement on our Telegram channel (t.me/emscanschannel) and, where reasonable, a brief in-app notice. Your continued use of the service after such changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, please stop using the service.

12. Governing Law and Disputes

These Terms are governed by, and will be interpreted in accordance with, the laws of the Republic of the Union of Myanmar, or, where local law requires otherwise, the laws of the jurisdiction in which EM Channel is operated, in each case excluding their conflict-of-laws rules. Before initiating any formal proceeding, you agree to first contact us in good faith at waiyanmoehein8@gmail.com and attempt to resolve the dispute informally. If we cannot resolve the dispute within sixty (60) days of your written notice, the dispute will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction. Nothing in this section prevents either party from seeking injunctive or equitable relief in any competent court.

13. Severability and Entire Agreement

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if no such modification is possible, severed from these Terms; the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the service and supersede any prior agreements on the same subject matter.
